<\/p>\n\n\n\n

An industrial park is a designated area where economic activities, scientific research, industrial production and services, the valorization of scientific research and\/or technological development are carried out under a specific regime of facilities, with the aim of capitalizing on the human and material potential of the area.<\/p>\n\n\n\n

What does the Industrial Parks Law say?<\/strong><\/h2>\n\n\n\n

According to<\/strong> Law No. 186\/2013 on the establishment and operation of industrial parks<\/em>, the industrial park title is the administrative act issued by the specialized body of the central public administration that grants an industrial platform, an existing industrial platform or land designated for an industrial park the legal status of an industrial park.<\/p>\n\n\n\n

The industrial park title grants the administrator and residents of the park the right to the following support measures (which constitute state aid\/de minimis aid and are granted in compliance with European state aid regulations):<\/p>\n\n\n\n

    \n
  1. exemption from the payment of fees charged for changing the designation or removing from the agricultural circuit the land belonging to the industrial park;<\/li>\n\n\n\n
  2. exemption from land tax, corresponding to the land belonging to the industrial park;<\/li>\n\n\n\n
  3. exemption from building tax, corresponding to the buildings that are part of the industrial park infrastructure;<\/li>\n\n\n\n
  4. exemptions, subject to the approval of local public administration authorities, from the payment of any fees owed to the local budgets of administrative-territorial units for the issuance of any urban planning certificates, building permits and\/or demolition permits for land and buildings within the park infrastructure that form an integral part of the industrial park;<\/li>\n\n\n\n
  5. other facilities that may be granted, in accordance with the law, by local public administration authorities.<\/li>\n<\/ol>\n\n\n\n

    Industrial park status<\/strong><\/h2>\n\n\n\n

    The application for the granting of an industrial park title is submitted by the founders of the industrial park.<\/p>\n\n\n\n

    In order to obtain the industrial park title, the following substantive conditions must be cumulatively met:<\/p>\n\n\n\n

    a) the park administrator must be legally registered in the Trade Register as a Romanian and\/or foreign legal entity;<\/p>\n\n\n\n

    b) the park administrator must not be subject to insolvency proceedings or proceedings for the prevention of insolvency.<\/p>\n\n\n\n

    c) the park administrator must not have any due and unpaid debt, established by an enforceable title as defined by law, to the consolidated state budget;<\/p>\n\n\n\n

    d) the land within the industrial park perimeter must be eligible, meaning that it must cumulatively meet the following conditions:<\/p>\n\n\n\n

    a) it is registered property or is held under concession or is under the administration\/use of the founder, the park administrator or the residents of the industrial park;<\/p>\n\n\n\n

    b) it has access to a European and\/or national and\/or county road and\/or ring road; where located within the built-up area of administrative-territorial units, industrial parks must have access to streets that allow easy access and circulation by vehicles transporting goods;<\/p>\n\n\n\n

    c) it has a compact surface area, except for areas crossed by transport routes, with a minimum area of 5 hectares;<\/p>\n\n\n\n

    d) it is not subject to any registered encumbrance, split ownership right, mortgage, precautionary measure or enforcement procedure, except for rights of way and mortgages established in favor of credit institutions in a European Union member state, in order to guarantee the repayment of bank loans and loans from non-bank financial institutions contracted by the founders of the industrial park or by the park administrator to finance the maintenance and\/or development and\/or modernization of the industrial park infrastructure, as well as its operation or the acquisition of assets forming part of the industrial park.<\/p>\n\n\n\n

    The title of industrial park<\/strong><\/a> is valid for the land and infrastructure of the industrial park and for the period expressly established by order of the Minister of Regional Development and Public Administration.<\/p>\n\n\n\n

    Benefits for companies operating in industrial parks and how companies can benefit from these facilities<\/strong><\/h2>\n\n\n\n

    The industrial park title grants the administrator and residents of the park the following benefits:<\/p>\n\n\n\n

    a) exemption from the payment of fees charged for changing the designation or removing from the agricultural circuit the land belonging to the industrial park;<\/p>\n\n\n\n

    b) exemption from land tax, corresponding to the land belonging to the park;<\/p>\n\n\n\n

    c) exemption from building tax, corresponding to the buildings that are part of the industrial park infrastructure;<\/p>\n\n\n\n

    d) exemptions, subject to the approval of local public authorities, from the payment of any fees owed to the local budgets of administrative-territorial units for the issuance of any urban planning certificates, building permits and\/or demolition permits for land and buildings within the park infrastructure that form an integral part of the industrial park;<\/p>\n\n\n\n

    e) other facilities that may be granted, in accordance with the law, by local public administration authorities.<\/p>\n\n\n\n

    The state aid measures provided for under the Industrial Parks Law are granted in accordance with the state aid scheme promoted by the Ministry of Regional Development and Public Administration within a maximum of 60 days from the entry into force of the law.<\/p>\n\n\n\n

    In addition, the park administrator has a number of duties and obligations: selecting park residents from among the economic operators that have submitted offers, in accordance with the regulations adopted for this purpose; concluding administration and related services agreements with the park residents selected in accordance with the applicable regulations; ensuring that park residents have the right to use the units covered by the administration and related services agreements concluded with them; ensuring that park residents have the right to use the common infrastructure; carrying out the agreed maintenance, repair and\/or modernization works and services, as applicable, on the park infrastructure, in order to ensure that park residents have normal use of the units, exclusive infrastructure and common infrastructure.<\/p>\n","protected":false},"excerpt":{"rendered":"
